REPORTING CHANNEL ACCORDING TO THE WHISTLEBLOWER PROTECTION ACT

Whistleblowers have been protected by the Whistleblower Protection Act since 2023, transforming the EU Whistleblower Directive. Companies with 50 or more employees must:

  • set up qualified reporting channels,

  • process incoming reports correctly and on time,

  • conduct legal investigations and

  • correspond with authorities and other parties.

Employees also include civil servants, judges, trainees and others. The reporting office must not be subject to any conflicts of interest. Violations of the Whistleblower Protection Act can be punished with fines of up to 50,000 Euros. Many companies wish to outsource this activity to specialized service providers.
